Consent + Scope of this Policy

By accessing our Services, you accept our Policy and Terms, and you consent to our collection, storage, use and disclosure of your PI information as described in this Privacy Policy. In addition, by using our Service (on our websites or across partnered and unaffiliated sites) you are accepting the practices described in this Policy. We will also ask for your specific consent to certain parts of the Service (i.e. newsletter subscription) via clickable boxes with legends similar or analogous to “I Accept”.

Here at Yesgamers, we work hard to earn and keep your trust; and therefore we adhere to the following principles in order to protect your privacy: (i) we will not sell or lease your PI to third parties; (ii) we will not disclose your PI with other users or third parties without your consent; (ii) any PI that you provide to Yesgamers will be secured with industry standard safety protocols and technology.

Privacy Policy covers the following Yesgamers services (“Services”): Yesgamers online platform and other Yesgamers services that have reference to this Privacy Policy (the “Websites” and “Apps”).

Personal Information Gathering

We may collect both “Non-Personal Information” and “Personal Information” about you. “Non-Personal Information” includes information that cannot be used to personally identify you, such as anonymous usage data, general demographic information we may collect, referring/exit pages and URLs, platform types, preferences you submit and preferences that are generated based on the data you submit and number of clicks. “Personal Information” includes information that can be used to personally identify you, such as your name, address, email address, nationality, home/business address, personal image (i.e. a picture of yourself incorporating your name and personal likeness), national identification, personal signature, mobile number and payment processing account details.

We collect data directly from you or our partners. When you visit our Websites and Apps we collect technical data and information about how you use the Websites and Apps. Data We Collect

Device and Location Data

When you visit our Websites and Apps, we collect the following data to recognize you and provide you with the Websites or Apps that are capable of your device, your location, etc:

  • IP address and location info (country, city, etc.)
  • Device and OS information (screen size, OS, browser information)

Account Data

When you log in to the Websites through your social network account, we collect specific data from a corresponding third party. This data may include your account ID (like Facebook or Google ID), avatar, username and other public information. You may provide additional information in your profile, such as your avatar.

Usage Data

We collect information about your use of the Websites and Apps. These data include your activity on the Websites, such information as:

Know-Your-Customer Data

We do our best to prevent fraud and other illegal activities. If your activity, transaction, or payment instrument seems suspicious to us we will ask you to provide additional information in order to complete the Know-Your-Customer procedure – carried out by a third-party service provider or us indirectly to identify and detect fraud:

  • First and last name
  • ID document (i.e. passport) number
  • Copy of your ID document
  • Picture of you holding an ID document
  • Photo of your bank card partly covered
  • Video of your face
  • Utility bill or bank statement

Payment and Purchase Data

When you make a purchase or request a refund, you disclose your payment credentials directly to a respective payment service provider, i.e., PayPal. They process your payment data under their privacy policies. We may receive from our payment partners and process a part of your credit card number information about your credit card issuer. For billing purposes, we may collect your full address.

Survey Data

From time to time, we organize surveys primarily for research purposes. For this purpose, we collect answers to the questionnaire and the responder’s profile (gender, age, education, occupation, place of residence). We may publish our research results in articles on public domains. Research results contain aggregated depersonalized information unless otherwise agreed upon in writing with the responder.

Personal Information Processing and Usage

Overall, we use your PI to provide and improve our Services. By storing your PI on our secure servers, we are able to shorten your login process and allow you to modify your personal profile online. We will generally collect, use and disclose your PI to:

• Provide, operate, maintain, improve, and promote our platform and our products and services.

• Verify your e-mail address; send password retrieval links and other account notices.

• Develop, research, process, safeguard and improve our services.

• Answer to comments, questions, and requests you submit to us.

If you do not wish to disclose any or part of your PI to us, you may still be able to use some of the functionalities of our Services, though we will not be able to guarantee that you will be able to enjoy them at their fullest if you elect not to disclose it to us. Overall, your final remedies will be to close this web tab, delete your account with us and/or exit our Service.

Information Collected from Payment Processors

We use third party payment partners in order to bill and process any payments and subscriptions made via our Services. These platforms will request you to disclose them sensitive information in order to complete purchases and operations related to our Services. Such third-party payment processing platforms are governed by their own safety standards, policies and terms of use. We take great care in selecting our third party payment processing platforms, and strive to be aware of their operations and functionalities. We strongly advise our users to engage in online safety measures and practices in order to protect their financial information.

How We Protect Your Information

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your PI, username, password, transaction information and data stored on our websites. Sensitive and private data exchange between Yes Gamers and its users happens over an SSL secured communication channel and is encrypted and protected with digital signatures.

Lawful Disclosure of Personally Identifiable Information

Yesgamers may disclose personally identifiable information under special circumstances, such as to comply with subpoenas or when your actions violate the Terms of any of our applications. Accordingly, we must reserve our right to disclose your PI when we or our affiliates, clients, contractors, licensors, officers, agents and/or representatives reasonably believe it necessary to protect our interests, or where you result to be in breach of our Terms and/or this Policy. Henceforth, we will have the right to disclose any and all collected PI and/or data, under the following circumstances: (i) if required under applicable law, rules or regulations; (ii) in response to a valid request or subpoena from a government or law enforcement agency; (iii) to defend ourselves and our affiliates, licensors, officers, agents and representatives from legal claims and processes brought to us by third parties (including takedown notices); (iv) to defend the property, rights and integrity of any of our users, advertisers or licensors; and/or (v) to stop or cause to cease any actions that we may consider to cause –whether allegedly or factually– a contingency or liability.

Sharing Your Personal Data

Data Retention

We store your Personal Data as necessary for providing you the Service, compliance with our legal obligations, fulfillment of our legitimate interests, or during the validity of your consent as stated in this Privacy Policy. As soon as information stops serving these purposes, we delete it. After you close your account and/or upon your request, we will delete and/or anonymize your Personal Data without undue delay but no later than 30 days. We will keep some Personal Data that we are allowed or required to maintain in such cases as:

  • If there were monetary transactions under your account, we would keep the data necessary for defending legal claims for 180 days from the last transaction;
  • If there is an unresolved issue relating to your account, such as an outstanding credit on your account and/or an unresolved claim and/or dispute – we will retain the necessary Personal Data until the said issue is resolved;
  • Where required to comply with legal, tax, audit, and accounting obligations and/or any other legal obligation, we will retain the necessary Personal Data for the period required by the applicable law;
  • Where necessary to fulfill our legitimate interests such as fraud prevention and/or maintenance of our Users’ security.

KYC data: ID document (i.e., passport) number, copy of your ID document, picture of you holding ID document, photo of your bank card partly covered, video of your face, utility bill, or bank statement are stored for three months for appealing chargebacks and resolving disputes.

Your Rights As A Data Subject

The General Data Protection Regulation (GDPR) allows individuals in the EU greater control over their personal data and grants them a number of rights with regard to how that data is processed, stored, and accessed.

For the purposes of the GDPR, in the European Union Yesgamers is both a “data controller” and a “data processor” of PI you provide to us for the primary purposes of providing you with our Services.

Right to access your Personal Data – You may request a copy of your Personal Data and/or how we store your Personal Data.

Right to rectification – you may request to change some of your Personal Data and/or correct your Personal Data if this is inaccurate.

Right to erasure – you may request to delete all or some of your Personal Data. For example, if:

  • they are no longer needed for any processing purposes;
  • consent has been used as a legal basis for their processing;
  • there is no legitimate interest in the further processing of Personal Data.

Right to object – you may object to processing your Personal Data on grounds relating to your particular situation and/or to object processing your Personal Data for direct marketing purposes.

Right to object to automated processing – you may object to a decision based on automated processing. It means that you may request to review your Personal Data manually if you believe that automated processing of your Personal Data may not consider your unique situation.

Right for data portability – you may request to provide you a copy of your Personal Data in a structured, commonly used, and machine-readable format (e.g, XML, CSV). Furthermore, you have the right to request to transmit the said Personal Data directly to another controller.

Right to lodge a complaint – you have the right to lodge a complaint with a supervisory authority, particularly to the European Union member state of your habitual residence, place of work, or place of the alleged infringement.

  • The categories of Personal Data we have collected about you;
  • The categories of sources from which the Personal Data was collected;
  • The categories of Personal Data about you we disclosed for a business purpose or sold;
  • The categories of third parties to whom the Personal Data was disclosed for a business purpose or sold;
  • The business or commercial purpose for collecting or selling the Personal Data; and
  • The specific pieces of your Personal Data we have collected.

If you are a California resident under 18 years old, you may request to remove any content or information you have posted on the Services.

Your privacy request must include, at the least, the following information: (i) your complete name, address and/or e-mail address in order for us to notify you the response to your request; (ii) attached documents establishing your identity; and (iii) a clear and concise description of the PI with regard to which you seek to enforce any of your privacy rights. If you request rectification, please indicate amendments to be made and attach documentation to back up your request. Upon receipt of your privacy request, and after due review, we may then edit, deactivate and/or delete your PI from our Services within thirty (30) days. In case of secure databases under our control where deletion is impossible, we will make such information permanently inaccessible.

Notice of Collection

In the past 12 months, we have collected the following categories of Personal Data listed in the CCPA:

  • Identifiers, including name, email address, and online identifiers (such as IP address).
  • Customer records, including credit or debit card information.
  • Commercial or transaction information, including records of products or services purchased, traded, and sold products or services.
  • Internet activity, including interactions with Websites, Apps, or advertisements.

Sale of Personal Data

We do not sell Personal Data as the term “sell” is traditionally understood. Although to the extent the word “sale” is interpreted under the CCPA, the fact that we use third-party cookies may be understood as a sale. We disclose the following categories of personal information: identifiers, commercial or transaction information, internet activity, and inferences drawn from Google Analytics, Facebook, TikTok, VKontakte (Third-party services). We only share Personal Data with Third-party services upon service contracts (Third-party services’ terms of use) to improve the service website functionality and provide personalized content and ads. Personal Data Breach

A Personal Data breach may result in a physical, material, or non-material risk to your rights and freedoms if not addressed appropriately and promptly. Therefore, as soon as we become aware that a Personal Data breach has occurred, we will notify the Personal Data Breach to the Commissioner for Personal Data Protection without undue delay and, where feasible, not later than 72 hours after having become aware of it, unless we can demonstrate, following the accountability principle, that the Personal Data breach is unlikely to result in a risk to your rights and freedoms. Where such notification cannot be achieved within 72 hours, the reasons for the delay should accompany the notice without undue further delay.

Children’s Privacy

We do not knowingly collect Personal Data from children or process such information without parental consent. For the purpose of this Privacy Policy, a child means any individual under 13 in the United States or under 16 in the European Union (or the minimum legal age to consent to the collection and processing of Personal Data where this is different under applicable law). Cross-Border Data Transfer

We may transfer Personal Data to data controllers and processors established outside the European Union (the “EU”) or European Economic Area (“the EEA”) for the purposes stipulated in this Privacy Policy. The countries where the data may be transferred may not provide adequate protection.

To ensure that Personal Data is safeguarded, stored, and processed securely, we use Standard contractual clauses (SCC) adopted by the European Commission as a mechanism to transfer data from the EU countries. Our partners established in countries with an inadequate level of personal data protection have adopted SCC, as appropriate, to ensure confidentiality, security, and legality of the processing of your personal data.

Email Communications & Opting Out

We collect the e-mail addresses of those who communicate with us via e-mail, aggregate information on what pages users’ access or visit, and information volunteered by the consumer (such as survey information and/or website registrations). We will send you Service-related announcements on occasions when it is necessary to do so. For instance, if our Service is temporarily suspended for maintenance, or a new enhancement is released, which will affect the way you use our Service, we might send you an email. Generally, you may not opt-out of these communications, which are not promotional in nature. Based upon the PI that you provide us, we may communicate with you in response to your inquiries to provide the services you request and to manage your account, among other and other promotional communications. Cookies & Web Beacons

A cookie is a small amount of data, which often includes an anonymous unique identifier that is sent to your browser from a web website’s computers and stored on your computer’s hard drive. Cookies are required to use the Services. We use cookies to record current session information, but do not require permanent cookies. We also use the so-called ‘beacons’, which are small files, sometimes only a pixel in size, embedded onto the pages of our websites. Beacons are used to identify each of our pages in order to be analyzed by our system. From time to time, we may use Google Analytics, Ad Words, Double Click and/or Ad Sense tracking codes, and other third-party software tools (such as remarketing codes) in order to collect information and marketing analytics about the manner in which you browse our platform and services. The served ads will be targeted based on your previous browsing history, and may include retargeting codes. For example, third-party vendors may show you Yesgamers’ ads on certain websites across the Internet, even after you leave our platform. The collected information is anonymized, meaning it cannot be tracked back to individuals. Using such tools, we learn how to optimize, and serve ads based on a user’s past visits, providing you with a better user experience. Our third-party vendors may also use cookies and beacons to track your Internet browsing in order to serve you ads based on what they or us believe to be of interest according to your browsing activities and consumer preferences. We may amend this Privacy Policy from time to time. We will post any changes to the Privacy Policy. Service Eligibility & Age of Consent

Through the simple use of our platform and our products and services, you hereby represent and warrant that you are at least eighteen (18) years of age –or older– as of the date of first access thereof. If you are still a minor (which may depend on the jurisdiction where you reside), you may only access our Services under the direct supervision of your parent or legal guardian. We reserve the right to request any and all necessary proof of the consent of your parent or legal guardian, at our sole and final discretion. Yesgamers does not knowingly collect any kind of information from persons under the age of thirteen (13). If we learn or have reason to suspect that any user is under the age of thirteen (13), we will delete any PI under that user’s account.

International Transfer Notice

Your PI may be accessed by us or our affiliates, agents, partners, advertisers or third-party service providers in Malta and our locations which may or may not be located in your country of residence, and you hereby consent to such access and transfer by simple disclosure. All Yesgamers related entities are subject to the privacy practices set out in this Policy and any applicable jurisdictional legislation.

Governing Language

From time to time, this Policy may be translated into other languages for your convenience. The English language version of each of these documents shall be the version that prevails and governs your use of Site and our products and services. Upon the case of any conflict between the English language version and any translated version, the English language version will prevail.
